- The department employees exclude the claimants’ “expert witness” testimony which conflicts with the their own Code of Federal Regulation, 29 C.F.R. § 18.702. A hearing before a department Administrative Law Judge is the lowest possible adjudication
process. The departments’ “interim regulations” do not replace
the provisions of the US Constitution, the US Codes, and/or the
US Federal Rules of Civil Procedure (FRCP) which are established
by the US Supreme Court for decades. The Administrative Law
Judges are not nominated by the US President or approved by the
members of Congress.

may offer testimony in the form of opinion on a matter of scientific,
technical or other specialized knowledge where it 'will assist the
judge as trier of fact to understand the evidence or determine a fact

Instead, the department supervisors dictate that their unqualified health physicists are “expert witness” for this EEOICP purpose. The class of department employees’ redundantly impose their imagined credentials that are always challenged by high profile scientists with PhD credentials. At
